One of the essential tasks you need to perform before setting up a company in the UAE, or anywhere for that matter, is to investigate the competitors and the business environment. The UAE's excellent business infrastructure attracts investors and entrepreneurs from all over the world, which has sparked increased competition in the business sector. This makes it imperative for businesses to take steps in order to protect their brands, and that is wheretrademark registrationin the UAE can help. Your company's assets are protected by law if you register your trademark in the UAE. With a registered trademark, you will also be legally recognized as the owner of the goods and services it covers.

Register your Trademark in UAE in 6 Simple Steps

Following are the 6 steps you need to take toregister a trademark in the UAE-:

1. Trademark Search:

Only after selecting a suitable trademark does the registration process for trademarks begin. The first step in obtaining a UAE trademark is to conductan online trademark searchto see if the mark you are after is already being used. If another business entity has already registered the particular mark, you are not allowed to use it. Once you've determined that the trademark isn't already in use, you can move on to the next stages of trademark registration in the UAE.

2. Filling the Application Form:

The Ministry of Economy's website is the official source that governs trademark applications, and the next step is to fill out an online application form on its website supported by uploading required documents. When applying for registration, more documents may be required on a case-by-case basis. But the common documents needed are:

  • A sample of Trademark Design
  • Contact Details of the Applicant
  • Identity Card or Passport of the person who will sign the Application
  • Trade License
  • Power of Attorney
  • List of Goods and Services to be Protected
3. Payment of the application fee:

Once you've completed your application, you'll have to pay the fees for the UAE trademark registration, which is around 1500 USD. There may be additional legal or translation costs associated with thistrademark registration fee. This payment can be made via the Ministry of Economy's e-services platform.

4. Examination of the Application:

After you submit your trademark application, the Ministry of Economy will assess it. You should pay close attention while filling out the form since any missing or incorrect information could lead to your application being rejected. Nonetheless, if an error is found, applicants can appeal or modify their filing and re-apply. If there are no issues with your application, the Ministry of Economy generally gives approval for the trademark within 30 days.

5. Publication in the Official Gazette:

After you submit the application and get approval, the Ministry of Economy will publish the notice of trademark in the Official Gazette. The Ministry will also publish the notice in two different national newspapers in the UAE. Anyone who has an objection to such trademark must file an opposition within 30 days after the notice is published. If someone objects to your trademark in that time period, the Ministry of Economy will review the objection, following which they will either reject it or inform you of the next steps to be followed.

6. Final registration of the Trademark:

If there has been no objection to your trademark in that time period, the Ministry of Economy will then provide you with a certificate ofregistration for your trademark in the UAE. The certificate will contain important information such as the trademark's registration number, the owner's name, the trademark itself, and a description of the goods and services covered by it. A trademark registered in the United Arab Emirates has a ten-year validity, after which it must be renewed for a fee. It is important to remember that registering a trademark in the UAE only protects it in the UAE's seven emirates, and not anywhere else in the world.

In recent times, fast-growing countries like the UAE have needed trademark registration services. This is because of the inflow of all the business and the competition in the local markets. And with that increasing competition, there has been an increase in ways to exploit successful businesses, especially in regards to theft of intellectual property. If you want to protect your company or inventions from theft, trademarking them is a good idea. This will cover all of your goods and trademarks, ensuring that your ideas are protected and that all legitimate income made from your business is returned to you.
